§ 30-154. Rules on retail food store sanitation.

  • The definitions; the inspection of retail food store establishments; the issuance, suspension and revocation of permits to operate retail food stores; the prohibition of the sale of unsound or mislabeled food or drink; and the enforcement of this article shall be regulated in accordance with the state department of health, "Bureau of Food and Drug Safety "Texas Food Establishment Rules 25TAC §§ 229.161—229.171, 229.173—229.175," incorporated in this section by reference to the same extent as if copied verbatim in this section, three copies of which shall be on file in the office of the city clerk; provided that in the event of any conflict between the provisions contained in this article and the state food establishment rules referred to in this section or any subsequent revisions or amendments thereto, then the provisions contained in this article shall control. The words "Municipality of Mineral Wells" and the term "regulatory authority" in this article shall be understood to refer to the city, its employees, agents, representatives, and enforcement personnel designated to enforce the provisions of this article. Any amendments or additions to such rules by the state department of health shall upon publication and filing in the office of the city clerk become regulations of the city and automatically be included in this section. All references to state statutes which have been recodified in other statutory publications since the promulgation of such rules shall refer to such recodifications.
